BY THE PORTUGUESE DATA PROTECTION AUTHORITY: E-VOTING, CNPD DEFENDS A STRICT SCRUTINY

The CNPD has assessed the experience of the e-voting in the last elections of the European Parliament and thinks that a strict control of this type of systems shall be carried out and ruled. 

The CNPD thinks that the lack of a juridical regulamentation into the e-voting experiences carried out into the Evora District, during the elections of the European Parliament in 2019, has been the basis of the irregularity detected into the investigation that the CNPD carried out., in particular as regard to the dematerialized electoral books and affirms that this regulation is essential for many lawful reasons of data processing operations, that guarantee the predictability and the certain of the election process. 

In the approved opinión this week, the CNPD claims that, even if the soundness of e-voting systems is still controversial and it has been detected some relevant weaknesses, the introduction of new e-voting ways, concerned merits, shall be adequately considered in the light of data protection legislation and risks that could ensue. 

The CNPD recommends that each evolution towards the e-voting implementation is prefaced by a strict control of the technology that must be implemented and of security (technical and organizational) measures provided, by asking the previous implementation of an efficient and exhaustive impact assessment of data protection.
